Please read these terms before using the Neon Belly website. They set the ground rules for using the Site, our content, and the services linked from it.
These Terms of Use cover your use of neonbellyband.com (the "Site"), which is run by the band Neon Belly ("Neon Belly," "we," "us"). By using the Site you agree to these terms, our Privacy Policy and our Disclosures. If you do not agree, please do not use the Site.
You may browse the Site for your own personal, non-commercial use. Please do not:
The Neon Belly name, logo, show flyers, photographs, videos, text, graphics and the Site's design and code are owned by Neon Belly or used with permission, and are protected by copyright and trademark law. All rights not expressly granted are reserved.
Press and promotional use. The logo, band photos and one-page booking sheet offered for download on the EPK page may be used by promoters, venues, media and event partners to advertise and report on Neon Belly appearances. Please use them as provided, without altering or distorting the logo, and do not suggest that Neon Belly endorses anything else. Any other use needs our written permission.
Songs and artists. We perform songs written and recorded by other artists. Those songs and the artist names, titles and marks belong to their owners. See our Disclosures.
We try to keep show dates, times, prices and venue details accurate, but they can change. Venues set their own rules, including age limits, cover charges and door times, so please check with the venue. Live music is loud and you attend shows at your own risk; see our warnings and hearing protection notice in the Disclosures. Sending us a booking inquiry, or receiving a reply, is not a contract. A booking exists only when both sides agree to the date, fee and other terms in writing.
Tips are voluntary gifts to the band. They are not a purchase, are not tax-deductible, and are generally not refundable. Payments are processed by Venmo under Venmo's own terms.
Merch prices and availability on the Site are estimates and may change. If you pay for an item and we cannot supply it, we will refund you. Please email us to confirm size and availability before you pay.
If you send us photos, video, quotes or other material and ask or allow us to share it, you confirm that you have the right to share it and you give us permission to display it on the Site and our social accounts, with credit where we can. You can ask us to remove it at any time by emailing neonbellytn@gmail.com.
The Site links to and embeds content from other services, such as YouTube, Instagram, Facebook, TikTok, Venmo and venue websites. We do not control them and are not responsible for their content, availability or practices. Using them is at your own risk and subject to their terms.
If you believe something on the Site infringes your copyright, or you appear in a photo or video and want it removed, email neonbellytn@gmail.com with the page address, a description of the material, and your contact details. For copyright claims, please also state that you are the owner or authorized to act for the owner. We will review and respond promptly, and remove material where appropriate.
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, availability, fitness for a particular purpose and non-infringement. We do not promise the Site will be uninterrupted, error-free or free of harmful components.
To the fullest extent the law allows, Neon Belly and its members will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of, or inability to use, the Site or from third-party content. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars ($100). Some places do not allow these limits, so they may not apply to you.
These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Williamson County, Tennessee, and you agree to their jurisdiction.
We may update these terms from time to time. The date at the top shows the latest version, and continuing to use the Site means you accept the update. If any part of these terms is found unenforceable, the rest stays in effect. These terms, with the Privacy Policy and Disclosures, are the whole agreement between you and us about the Site.
